Saint Andre KP Law, P.C. 101 Arch Street Boston, MA 02110 Dear Attorney Saint Andre: I have received the petition of Robert Murchison appealing the response of the Town of Sherborn (Town) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Murchison requested cell phone records of a specifically-named person using a personal cell phone for Town business. The Town provided Mr. Murchison with response to his request on July 15 and supplemental response on August 15. This request was subject of a prior appeal. See SPR16/694 Supervisor of Records Determination (September 16, 2016). In compliance with my order you provided a letter to Mr. Murchison, dated September 23, 2016. In the letter you explain that the individual in question "was not a Town employee during the time period noted" in Mr. Murchison's request. You further explain that the "Town did not issue [that person] a cell phone, pay for [the person's] phone service, or monitor [the person's] cell phone use." Finally, you explained that the Town considered any cell phone use during the relevant period to be use of a "personal phone." You further explain that the individual "did not submit bills" for the cell phone to the Town. I find this explanation satisfies the specificity required by my prior administrative order, indicating that the Town has no responsive records.
