Williams Supervisor ofR ecords October 18, 2016 SPR16/834 Mr. Sabino Piemonte City of Boston Election Department 1 City Hall Square, Room 241 Boston, MA 02201-2008 Dear Custodian: I have received the petition of Don Saklad appealing the response of the Boston Election Department (Department) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Saklad requested a "sample Absentee Ballot for Ward 3 Precinct 5." On October 5, 2016 you denied his request. In an email to Mr. Saklad dated October 17, 2016, a copy of which was provided to this office, you explained that by statute "an absentee ballot can only be provided to duly registered voters of the city or town." G. L. c. 54, § 91. You further explained that, "as [Mr. Saklad is] not a registered voter in Ward 3, precinct 5 of Boston, [the Department is] unable to provide [Mr. Saklad] with an absentee ballot." You further explained that the Department has no sample absentee ballots.
