Department of Revenue Litigation Bureau 100 Cambridge Street, ih Floor Boston, MA 02114-9565 Dear Attorney Randall: I have received the petition of Todd Feathers of The Lowell Sun appealing the September 27, 2016 response of Department of Revenue (Department) to a September 23, 2016 request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Feathers requested a copy of of Department records "that record the transfer/sale of a Massachusetts tax credit from one party to another." Mr. Feathers explained he is not seeking "information filed by a taxpayer, individual or corporate with the [Department]." On September 27, 2016, the Department provided Mr. Feathers with a response denying his request and informing him that, while certain information may be available online, other responsive records would be withheld from disclosure. G. L. c. 62C, § 21(a); 830 C.M.R. 62C.21.1(2). Mr. Feathers appealed. In an October 17, 2016 telephone conversation with an attorney on my staff you indicated the Department will provide a more detailed response to Mr. Feathers. It is my understanding that my staff attorney provided you with a copy of the appeal file to assist you. Accordingly, I will consider this administrative appeal closed with the proviso that a supplemental response is provided to Mr. Feathers, prepared in a manner consistent with this order, the Public Records Law and its Regulations. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at re sec.state.ma.us.
