Szocik Executive Office of Energy and Environmental Affairs Department of Agricultural Resources 251 Causeway Street, Suite 500 Boston, MA 02114 Dear Ms. Szocik: I have received the petition of Craig Olson appealing the response of the Department of Agricultural Resources (Department) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Olson requested copies of records regarding Emergency Order 1-AH0-05 and House Bill H.649. In a response dated September 19, 2016 the Department provided certain responsive records concerning House Bill H.649 and stated that it does not have any records responsive to his request regarding Emergency Order 1-AH0-05. Thereupon, Mr. Olson petitioned this office, it is his belief that additional records exist. Subsequent to the intervention by a member of my staff, this office was notified that a revised response would be provided. Whereas this matter was opened based upon the Department's response, I will now consider this administrative appeal closed. Mr. Olson may appeal the substantive nature ofthe Department's response within ninety (90) days.
