G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Spaulding requested copies of what he describes as "nasty emails" he allegedly sent to certain Department staff. In a response dated October 6, 2016, the Department provided him a fee estimate for the provision of responsive records. In Mr. Spaulding's petition to this office, he argues that the Department's fee estimate is for copies of all the emails he sent to the Department; Mr. Spaulding only requested copies of "nasty emails" he allegedly sent to certain Department. Accordingly, the Department is ordered to review Mr. Spaulding's request and provide Mr. Spaulding a revised response prepared in a manner consistent with the Public Records Law and its Regulations addressing his concerns. A copy of any such response must be provided to this office.
