Board Counsel Board of Registration in Medicine 200 Harvard Mill Square, Suite 390 Wakefield, MA 01880 Dear Attorney Harvey: I have received the petition of Colman Herman appealing the response of the Board of Registration in Medicine (Board) to a request for public records. G. L. c. 66 § lO(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Herman requested a copy of the file of a specifically identified individual. In a response dated September 30, 2016, the Board provided certain responsive records and withheld others. Mr. Herman appealed, indicating the Board has yet to provide all responsive records. In his appeal petition, Mr. Herman indicates that subsequent to the Board's September 30 response, he inquired about certain emails that had yet to be produced. Subsequent to the intervention by a member of my staff, this office was notified that a response addressing the emails referenced above was provided, dated October 26, 2016. Whereas this matter was opened based upon the Board's failure to provide a written response regarding the emails, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Board's response within ninety (90) days. See 950 C.M.R. 32.08(2).
