Corporation Counsel City of Fall River One Government Center Fall River, MA 02722 Dear Attorney Macy: I have received the petition of C.J. Ferry of Spindle City Straight Talk appealing the response of the City of Fall River (City) to his request for public records. G. L. c. 66 § IO(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Ferry requested a copy ofrecords regarding the City's "Pay as You Throw Bags" (PAYT) from May 1, 2016 to August 8, 2016 (date ofrequest). This request was the subject of a previous appeal. See SPR16/649 Determination of the Supervisor of Records (September 1, 2016). I ordered the City to provide Mr. Ferry with a complete response to his request. On October 20, 2016, the City provided a supplemental response, and Mr. Ferry appealed. Mr. Ferry believes the records were previously compiled. In an October 26, 2016 conversation with an attorney on my staff you agreed to review the responsive records to determine whether the responsive records were previously compiled, thereby reducing any fees associated with Mr. Ferry's request. Accordingly, the City must provide Mr. Ferry with a revised response to his request within ten (10) days, prepared in a manner consistent with this and prior orders, the Public Records Law and its Regulations. A copy of any such cover letter or response that may accompany the records must be provided to this office.
