Ciccia Privacy Office Executive Office of Health and Human Services One Ashburton Place Room 1109 Boston, MA 02108 Dear Mr. Ciccia: I have received the petition of Andrew Quemere appealing the response of the Executive Office of Health and Human Services (Office) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Quemere requested "all orders of suspension/temporary suspension of medical licenses issued by the Board of Registration in Medicine between January 1, 2010 and the present." In your response, you explained that, as the Office does not possess the responsive records, Mr. Quemere's request would be best served by contacting the Board of Registration in Medicine (BO RIM). Mr. Quemere appealed. In your letter, you provide contact information for the BORIM Records Access Officer, and encouraged Mr. Quemere to contact BORIM directly. I find the Office acted appropriately in explaining it is not the custodian of the responsive records.
