G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Relihan requested copies of records regarding marijuana generated from December 2014 to the date of the request (May 2016). The Department informed Mr. Relihan that the request would take some time to complete and that an employee was working on the request. On October 26, Mr. Relihan petitioned this office, stating that he has not received any of the requested records. On October 28, after the intervention of a member of my legal staff, you contacted this office and Mr. Relihan, stating that the Department was working with its computer staff and Mr. Relihan to isolate the particular records responsive to his request. I find the Department has complied with Mr. Relihan by communicating directly with him in an effort to expedite its search for responsive records. If the Department provides Mr. Relihan with a cover letter or written response to accompany the records, a copy of the response must be provided to this office.
