Krupanski, Esq. Assistant General Counsel Massachusetts Bay Transportation Authority 10 Park Plaza Boston, MA 02116 Dear Attorney Krupanski: I have received the petition of Elizabeth A. Sloane, Esq. appealing the nonresponse of the Massachusetts Bay Transportation Authority — Contracts Department (MBTA) to a September 12, 2016 request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, on September 12, 2016 Attorney Sloane requested a copy of certain certified payroll records. Having received no response from MBTA’s Contracts Department, Attorney Sloane petitioned this office. A member of my legal staff spoke to you this morning, and learned that you never received a copy of the request. As a courtesy, a member of my staff forwarded a copy of the appeal file to you on October 28 to assist the MBTA in responding to Attorney Sloane’s request. I advise the MBTA to instruct Attorney Sloane as to the identity of the records access officer for future requests to ensure a timely response. Whereas this matter was opened based upon the MBTA’s failure to provide a written response, I will now consider this administrative appeal closed with the proviso that MBTA provides Attorney Sloane with a written response within ten (10) days.
