Town of Kingston- Conservation Commission Kingston Town House 26 Evergreen Street Kingston, MA 023 64 Dear Attorney Talerman: I have received the petition of Daniel Harlow appealing the response of the Town of Kingston.:_ Conservation Commission (Commission) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Harlow requested copies of records associated with meetings held by the Commission. These requests were the subject of previous appeals. See SPR16/266, SPR16/581 and SPR16/582, and SPR16/868 Determinations ofthe Supervisor of Records (May 4, 2016, August 18,2016, and October 20, 2016). In his petition, Mr. Harlow states his belief that he has not been provided all records responsive to his requests. Subsequent to the intervention by a member of my staff, this office was notified that a response was provided on November 1, 2016 in which the Commission provided additional responsive records. The Commission also explained it provided all responsive records with the exception of emails withheld under the attorney-client privilege. Whereas this matter was opened based upon Mr. Harlow's uncertainty whether all responsive records were provided and the Commission has now addressed this concern, I will consider these appeals closed. Mr. Harlow may appeal the Commission's withholding of records within ninety (90) days. See 950 C.M.R. 32.08(2).
