Department of State Police 470 Worcester Street Framingham, MA 01702 Dear Attorney Farrell: I have received the petition of Stephen Stoute appealing the non-response of the Department of State Police-Medford Barracks (Department) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Stoute requested a copy of records associated with an April 3, 2016 motor vehicle accident. Mr. Stoute objects to the $20.00 associated with records responsive to this request. If there are fees associated with a request for records a written, good faith estimate must be provided. G. L. c. 66, § 10(a); see also 950 C.M.R. 32.06(2). Mr. Stoute was not provided with a written estimate. It is my understanding that the Department intends to provide a written response to Mr. Stoute's request. Accordingly, I will consider this appeal closed with the proviso that the Department provides a written response without delay, prepared in a manner consistent with this order, the Public Records Law and its Regulations. A copy of any such response must be provided to this office.
