G. L. c. 66 § 1 O(b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Kaspan requested a specific document he believed to be associated with his personnel file. The Town denied his request, claiming that the file requested was not an element of Mr. Kaspan's personnel file. G. L. c. 149, § 52C. Mr. Kaspan appealed. In a November 2, 2016 email, you indicated the Town would reach out to Mr. Kaspan to assist in his request. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Kaspan may appeal the substantive nature of the Town's response within ninety (90) days. See 950 C.M.R. 32.08(2).
