G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Ms. Lazar requested records pertaining to an August 17, 2016 incident at Wachusett Manor Nursing Home. In your October 19, 2016 response you denied the request, stating the incident was still under investigation. Ms. Lazar contends that the investigation has concluded. Subsequent to the intervention by a member of my staff, this office was notified by you that a revised response would be provided without delay. Any such response must be prepared in accordance with the Public Records Law and its Access Regulations. Ms. Lazar may appeal the substantive nature of the Department's response within ninety (90) days.
