Box 43 Norfolk, MA 02056 Dear Superintendent Medeiros: I have received the petition of Carlos Henriquez appealing the nonresponse .of the Massachusetts Department of Corrections (Department) to a request for public records. G. L. c. 66 § lO(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Henriquez requested a copy of the "approved departmental substitution guidelines." Having received no response, Mr. Henriquez petitioned this office. Subsequent to the intervention by a member of my staff, this office was notified that a response was provided, dated October 28, 2016. Coincidentally, this is the same date on which Mr. Henriquez's appeal was processed at this office. Whereas this matter was opened based upon the Department's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Henriquez may appeal the subst tive nature of the Department's response within ninety (90) days.
