Deputy Auditor and General Counsel Office of the Auditor of the Commonwealth One Ashburton Place, Room 1819 Boston, MA 02108 Dear Deputy Auditor Dooling: I have received the petition of Coleman Herman appealing the response of the Office of the Auditor of the Commonwealth (Office) to a request for public records. G. L. c. 66 § lO(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Coleman sought copies ofrecords associated with the Auditor. In a response dated October 24, 2016, the Office provided certain of the responsive records and withheld others in their entirety pursuant to a claim of attorney client privilege. Mr. Herman appealed. It is my understanding that on or about November 3, 2016 a member of my staff contacted you and provided you with a copy of the file related to this appeal and you confirmed that the Office would provide Mr. Herman with a revised response addressing his concerns. Whereas this matter was opened based upon the Office's response, I will now consider this administrative appeal closed with the proviso that the Office provides such a response. Mr. Herman may appeal the substantive nature of the Department's resp nse within ninety (90) days. See 950 C.M.R 32.08(2).
