G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Shibley requested "a .pdf copy of the related investigative report associated with the Town of Hubbardston's former Tax Collector. ..." Previous appeal This request was the subject of a previous appeal. See SPR 16/860 Determination of the Supervisor of Records (October 21, 2016). In my October 21, 2016 determination, I closed the appeal with the proviso that the DAO provide a response to Mr. Shibley, prepared in a manner consistent with the Public Records Law and its Access Regulations (Regulations). In compliance with my order, the DAO provided a letter dated November 2, 2016 denying Mr. Shibley's request pursuant to Exemption (f) of the Public Records Law. G. L. c. 4, § 7(26)(£). In this response, the DAO explained the record related to an active matter in the Worcester Superior Court, further explaining the next court date would be November 16, 2016. Mr. Shibley informed this office he seeks further action in this matter and this appeal (SPR16/1 007) was opened as a result. Recent developments Subsequent to the opening of this appeal Mr. Shibley notified this office that he believes the matter concluded on November 16. I understand you confirmed this with an attorney on my staff and indicated the DAO will provide a supplemental response to Mr. Shibley as a result.
