Krupanski Assistant General Counsel MBT A Law Department 10 Park Plaza Boston, MA 02116 Dear Custodian: I have received the petitions of Kyle Clauss appealing the nomesponse ofthe Massachusetts Bay Transportation Authority (Authority) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Mr. Clauss made two (2) separate requests to the Authority for data regarding employees hired at the request of or appointed by Governor Baker for a specified time frame, all consultant contracts supporting the Human Resources Department for a specified time frame, and compliance data related to a specified absenteeism policy. Having received no response, Mr. Clauss petitioned this office. Subsequent to the intervention by a member of my staff, this office was notified that responses were provided to both of Mr. Clauss' requests, dated November 7, 2016 and November 8, 2016. Whereas this matter was opened based upon the Authority's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Clauss may appeal the substantive nature of the Authority's response within ninety (90) days.
