The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Shawn A Williams Supervisor of Records December 7, 2016 SPR16/1043 Jackie Cowin, Esq. KP Law, P.C. 10 1 Arch Street Boston, MA 02110 Dear Attorney Cowin: I have received the petition of Dr. Hazem Mahmoud, MD, PhD related to his requests for public records made to the City ofNewburyport. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Dr. Mahmoud requested copies of records that bear his name, the name of his wife, or reference a specific address. The City has previously provided responsive records from the Police Department. What remains is Dr. Mahmoud's requests to the City, and the City's response in the form of a fee estimate. It does not appear from my review of the file that the City has withheld or denied access to any of the responsive records. I find the estimate provided by the City to Dr. Mahmoud contains the detail required by the Public Records Access Regulations. 950 C.M.R. 32.06. Once Dr. Mahmoud pays the estimated fee, the City must provide the remaining responsive records. If Dr. Mahmoud is not satisfied with the determination in this matter, this office shares jurisdiction with the Superior Court of the Commonwealth. See . L. c. 66, § 1 O(b) (pursuing administrative appeal does not limit availability of applicable j icial remedies). cc: Dr. Hazem Mahmoud One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us
