Office of the Attorney General One Ashburton Place Boston, MA 02108 Dear Attorney Tarrow: I have received the petition of Corey Spaulding appealing the nonresponse of the Office of the Attorney General (Office) to a request for public records. G. L. c. 66 § lO(b); see also 950 C.M.R. 32.08(2). Specifically, on October 26, 2016, further clarified on October 28, 2016, Ms. Spaulding requested records pertaining to a 2011 complaint in which Ms. Spaulding was the complainant. In a November 15, 2016, email to Ms. Spaulding an AGO staff member identifying himself as the "public records officer" stated he would complete and provide a response shortly. Ms. Spaulding received one record, but not the 2011 record and she appealed. Subsequent to the intervention of my office you informed a member of my staff that the AGO will respond; however, the AGO considers Ms. Spaulding's request as a request made under the Fair Information Practices Act rather than a request made under the Public Records Law. G. L. c. 66A. It is important to note that the "public records officer" did not explain this in his November 15 email to Ms. Spaulding.
