Williams Supervisor ofR ecords December 9, 2016 SPR16/1096 Kristin Esposito McRae Town of Lynnfield-Health Department 55 Summer Street Lynnfield, MA 01940 Dear Ms. McRae: I have received the petition of Julie Connolly, Esq. appealing the nonresponse of the Town of Lynnfield- Health Department (Department) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Attorney Connolly requested a number of records pertaining to "the spring at 165 Lowell Street." Having received no response, Attorney Connolly petitioned this office. Subsequent to the intervention by a member of my staff, this office was notified by you that a response will be provided. Whereas this matter was opened based upon the Department's failure to provide a written response, I will now consider this appeal closed with the proviso that the Department provide a response to the request. Attorney Connolly may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(2). To assist in requesting and responding to requests for public records please refer to our publication, A Guide to the Massachusetts Public Records Law.
