The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Shawn A. Williams Supervisor of Records December 7, 2016 SPR16/1101 David C. Jenkins, Esq. KP Law, P.C. 101 Arch Street Boston, MA 0211 0 Dear Attorney J enk:ins: I have received the petition of Carrie DeAngelo appealing the response of the Town of Truro-Police Department (Town) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Ms. DeAngelo requested a copy of a report from Retired Fall River Police Chief John Souza to Town of Truro Police Chief Kyle Takakjian "that reviewed the curriculum and Sgt. DeAngelo's performance at the training conducted by Chief Souza. The Town is withholding the report in its entirety pursuant to Exemption (f) of the Public Records Law. Ms. DeAngelo appealed. This report was the subject of a prior appeal by Ms. DeAngelo's Attorney Patrick N. Bryant of Pyle Rome Ehrenberg, P.C. and a determination by this office. See SPR16/786 Determination of the Supervisor of Records (October 18, 2016). In my October 18 determination, I found that the Town had met its burden of properly withholding the report pursuant to Exemption (f). After another review, I decline to reverse my October 18,2016 determination. IfMs. DeAngelo is not satisfied with the resolution of this administrative appeal, please be advised that this office shares jurisdiction with the Superior Court of the Commonwealth. See G. L. c. 66, § 1O (b) (pursuing administrative appeal does not limit availability applicable judicial remedies). cc: Carrie DeAngelo Chief of Police Kyle Takakjian One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us
