Williams Supervisor ofR ecords December 2, 2016 SPR16/1103 Mr. Timothy Luff Natick Public Schools Office of the Superintendent 13 East Central Street Natick, MA 01760 Dear Mr. Luff: I have received the petition of John Spaulding appealing the nonresponse of the Natick Public School Department (Department) to a request for public records. G. L. c. 66 § 1 O(b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Spaulding requested copies of what he describes as "nasty emails" he allegedly sent to certain Department staff. This request was the subject of a previous appeal. See SPR 16/894 Determination of the Supervisor of Records (October 21, 2016). In my October 21, 2016 determination I ordered the Department to review Mr. Spaulding's request and provide him with a revised response prepared in a manner consistent with the Public Records Law and its Regulations addressing his concerns. In a November 28, 2016 email Mr. Spaulding notified this office that he had not received any such response from the Department and this appeal was opened. Subsequent to the intervention by a member of my staff, this office was provided with a copy of a response sent to Mr. Spaulding on October 26. 2016. Whereas this matter was opened based upon the Department's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Spaulding may appeal the substantive nature of the Department's response within ninety (90) days.
