The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Shawn A. Williams Supervisor ofR ecords December 14, 2016 SPR16/1157; SPR16/1158 Ms. Jennifer Samson Legal Assistant Office of the Legal Adviser Boston Police Department Boston, MA 02120-2014 Dear Ms. Samson: I have received the petition of James Ware appealing the nonresponse of the Boston Police Department (Department) to two (2) requests for public records. G. L. c. 66 § lO(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Ware requested a copy of the Department's "Murder Book" for a specified investigation as well as all Internal Affairs records for specifically identified employees. Having received no response, Mr. Ware petitioned this office. Subsequent to the intervention by a member of my staff, this office was notified that responses were provided to both of Mr. Ware's requests, dated December 12, 2016 and November 15, 2016, respectively. Whereas this matter was opened based upon the Department's failure to provide a written response, I will now consider this administrative appeal closed. Mr. Ware may appeal the substantive nature of the Department's response within ninety (90) days.
