Staff Counsel Department of State Police Headquarters 470 Worcester Road Framingham, MA 01702 Dear Attorney Migliaccio: I have received the petition of Frances Phares, Esq. ofBaum, Heldund, Aristei & Goldman, on behalf of her client Glen Hill, appealing the nomesponse of the Department of State Police (Department) to a request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Attorney Phares requested copies of all communications from a specifically identified Trooper and any records concerning a specified incident. This request was the subject of a previous appeal. See SPR 16/1011 Determination of the Supervisor of Records (November 14, 2016). As indicated in my November 14 determination, the Department was reviewing Attorney Phares' request and was ordered to provide a response without delay. Attorney Phares contacted this office requesting further assistance upon not receiving a final response. Subsequent to the opening of this appeal, this office was notified that a response was provided, dated December 20, 2016. Whereas this matter was opened based upon the Department's failure to provide a written response, I will now consider this administrative appeal closed. Attorney Phares may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(2). cc: Frances Phares, Esq.
