Dear Ms. O’ Donnell:

I have received the petition of Mike Beaudet of WCVB-TV appealing the response of the Massachusetts Port Authority (Authority) to a request for public records. G. L. c. 66 § 10(b); see also 950 C.MLR. 32.08(2). Specifically, Mr. Beaudet requested a list of specific Authority and other state employees, as well as certain information in the Authority’s payroll reports from years 2014 and 2015.

The Authority provided Mr. Beaudet with information he initially requested in an undated response. Mr. Beaudet subsequently submitted a request for additional information from the Authority; a response was provided June 9, 2016 in which the Authority states that they “will make all responsive public records available [...] as soon as possible.” Mr. Beaudet indicates, to date, he has not received a response from the Authority. I understand that a member of my staff contacted the Authority about this appeal.

Whereas the Authority indicated it would provide a further response to Mr. Beaudet, I will now consider this administrative appeal closed with the proviso that the Authority provides a written response to the request without delay made in compliance with this order, the Public Records Law, and its Regulations. Mr. Beaudet may appeal the substantive nature of the Authority’s response with ninety (90) days. See C.M.R. 32.08(2)
