The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S, Murray Supervisor of Records December 29, 2016 SPR16/1238 James Malloy Town of Monroe — Board of Selectmen 30 School Street Monroe, MA 01350 Dear Mr. Malloy: I have received the petition of Arthur Butler appealing the nonresponse of the Town of Monroe — Board of Selectmen (Town) to a request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Malloy requested a number of records pertaining to “copies of payroll records (and) ALL applicable complete Minimum Wage schedules.” Having received no response, Mr. Butler petitioned this office. Despite being provided with an acknowledgement letter for the opening of this appeal dated December 27, 2016 and a member of my staff attempting to contact you by phone and leaving several voice messages for the Town, the Town has failed to respond to the request. Accordingly, the Town is hereby ordered without delay to review the request made by Mr. Butler and provide a written response to Mr. Butler, made in accordance with the Public Records Law, its Access Regulations and this order. Mr. Butler may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(2). To assist in requesting and responding to requests for public records please refer to our publication, A Guide to the Massachusetts Public Records Law.
