Corporation Counsel One Government Center Room 627 Fall River, MA 02722 Dear Mr. Macy: I have received the petition of C.J. Ferry appealing the nonresponse of the City of Fall River- Office of the Corporation Counsel (City) to a request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). Specifically, Mr. Ferry requested four (4) categories of records all pertaining to construction done within the city. Having received no response, Mr. Ferry petitioned this office. Subsequent to the intervention by a member of my staff, this office was notified that a response would be provided without delay. Whereas this matter was opened based upon the City's failure to provide a written response, I will now consider this administrative appeal closed with the proviso that Mr. Ferry receives a response to his request. Mr. Ferry may appeal the substantive nature of the City's response within ninety (90) days. See 950 C.M.R. 32.08(2). To assist in requesting and responding to requests for public records please refer to our publication, A Guide to the Massachusetts Public Records Law.
