Town of Brookline Office ofthe Town Counsel 3 3 3 Washington Street Brookline, MA 02445 Dear Attorney Correa: I have received the petition of Brooks Ames appealing the response of the Town of Brookline-Office ofthe Town Counsel (Town) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Ames requested a copy of an "Incident Plan" prepared by the Brookline Police Department. In correspondence between the Town and Mr. Ames, the Town noted its intension to withhold a copy of an Incident Plan, citing Exemption (n). This request was the subject to a previous appeal. See SPR17/ 031 Determination of the Supervisor of Records (January 5, 2017). Conclusion Subsequent to intervention by a member of my staff, I learned that the Town plans to provide Mr. Ames a supplemental response in regards to the Incident Plan. Accordingly, I will now consider this administrative appeal closed with the proviso that the Town provide said response to Mr. Ames, provided in accordance with the Public Records Law and its Regulations. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@,sec.state.ma.us. Rebecca S.
