The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S Murray Supervisor of Records January 24, 2017 SPR17/059 Lorraine A. G. Tarrow, Esq. Office of Attorney General Maura Healey Executive Bureau General Counsel's Office One Ashburton Place, 20th Floor Boston, MA 021 08 Dear Attorney Tarrow: I have received the petition of Kenneth Reed appealing the response of the Office of the Attorney General (AGO) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Reed requested five (5) categories of records related to a particular "Enforcement Notice." In a response dated December 23, 2016, the AGO provided certain records and withheld others under Exemptions (c), (d), and (n) ofthe Public Records Law. G. L. c. 4, § 7(26)(c), (d), (n). It is my understanding that the public records in question are the subject of a dispute in active litigation in U.S. District Court. See Civil Action No. 1:17-cv-10107. Accordingly, I decline to opine on this matter. See 950 CMR 32.08(2)(b). Sincerely, ~~mlui~ Rebecca S.
