Assistant City Solicitor City ofNewton 1000 Commonwealth A venue Newton Centre, MA 02459 Dear Mr. Howard: I have received the petition of Kerry Hurwitz appealing the response of the City of Newton-Law Department (Department) to a request for public records. G. L. c. 66 § 1O (A); see also 950 C.M.R. 32.08(1 ). Specifically, Ms. Hurwitz requested documents that had not been included in a response from the Department from Ms. Hurwitz's initial request for records. Subsequent to the intervention by a member of my staff, I learned that the Department plans to provide a supplemental response which will include the remaining documents. The Department indicated that they will provide the aforementioned records as early as January 13, 2017. Accordingly, I will now consider this administrative appeal closed with the proviso that the Department provide said response without delay. Ms. Hurwitz may appeal the substantive nature of the Department's response within ninety (90) days. See C.M.R. 32.08(1). A copy of any such response must be provided to this office.
