The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor ofR ecords January 18, 2017 SPR17/067 Lieutenant Detective Michael McCarthy Director, Office of Media Relations Boston Police Department One Schroeder Plaza Boston, MA 02120 Dear Lt. Det. McCarthy: I have received the petition of Evan Anderson appealing the nonresponse of the Boston Police Department (Department) to a request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Anderson requested copies of emails between the Department and the National Security Agency (NSA), as well as any emails containing NSA or National Security Agency, for certain specified time periods. This request was the subject of previous appeals. See SPR16/628 Determination ofthe Supervisor of Records (September 2, 20 16); SPR1611162 Determination of the Supervisor of Records (December 19, 2016). In the December 19, 2016 Determination, the appeal was closed with the proviso that the Department provide Mr. Anderson with a supplemental response to this request. Mr. Anderson petitioned this office under the basis that he has yet to receive this supplemental response and this appeal was opened. Subsequent to the intervention by a member of my staff, this office was notified that a response was provided, dated January 18, 2017. Therefore, whereas this matter was opened based upon the Department's failure to provide a written response I will now consider this administrative appeal closed. Mr. Anderson may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, ~~lj)f 11tuAJ~ Rebecca S.
