Town Attorney Town of Barnstable 367 Main Street Hyannis, MA 02601 Dear Attorney Weil: I have received the petition of Steve Kaspan appealing the response of the Town of Barnstable (Town) to a request for public records. G. L. c. 66 § 10(b); see also 950 C.M.R. 32.08(2). This request was the subject of a previous appeal. See SPR16/1196 Determination of the Supervisor of Records (December 20, 2016). In a response to this Determination, on December 23,2016 the Town provided Mr. Kaspan with a copy ofthe responsive record with a portion redacted. In the Town's December 23, 2016letter you explained the Town withheld the redacted portion pursuant to Exemptions (a) and (c), the statutory and privacy exemptions to the Public Records Law. Mr. Kaspan appealed. I understand an attorney on my staff contacted you on January 19, 201 7 and you indicated the Town would provide Mr. Kaspan with a supplemental response. Accordingly, I will consider this appeal closed with the proviso that the School provide Mr. Kaspan with said response. Mr. Kaspan may appeal the substantive nature of the Town's response within ninety (90) days. See C.M.R. 32.08(1). A copy of any such response must be provided to this office.
