Office of Town Counsel Town of Rochester 1 Constitution Way Rochester, Ma 02770 Dear Attorney Bailey: I have received the petition of David Eckert appealing the response of the Town of Rochester (Town) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1 ). This request was the subject of a previous appeal. See SPR17 /005 Determination of the Supervisor of Records (January 10, 20 17). I closed SPR17/ 005 with the understanding the Town had provided the responsive records to Mr. Eckert. On January 13, 2017 Mr. Eckert informed this office that he had not, in fact, received any responsive records from the Town. Subsequent to the intervention by a member of my staff, this office was notified that the Town provided responsive records with a response dated January 19, 2017. I will now consider this administrative appeal closed. Mr. Eckert may appeal the substantive nature of the Tov.rn's response within ninety (90) days. See 950 C.M.R. 32.08(1).
