The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records January 23, 2017 SPR17/080 Kate McKeever, Esq. General Counsel Executive Office of Energy and Environmental Affairs 10 0 Cambridge Street, Suite 900 Boston, MA 02114 Dear Attorney McKeever: I have received the petition of Attorney Joshua D. Krell, of Clark, Hunt, Ahern & Embry appealing the nonresponse of the Executive Office of Energy and Environmental Affairs (EOEEA) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Attorney Krell, on behalf of his client, requested a copy of several categories of records. Despite an order from this office dated October 11, 2016, Attorney Krell claims to have not yet received a response. As such, Attorney Krell petitioned this office. Subsequent to intervention by a member of my staff, I learned that the EOEEA provided Attorney Krell with a response on January 23, 2017. Whereas this matter was opened on the basis of the EOEEA's failure to provide a written response, I will now consider this administrative appeal closed. Attorney Krell may appeal the substantive nature of the EOEEA's response within ninety (90) days. See C.M.R. 32.08(1). Sincerely, M~ i'YVL<AA:Ht(J Rebecca S.
