Assistant City Solicitor Newton Law Department 1000 Commonwealth A venue Newton Centre, MA 02459 Dear Attorney Murray: I have received the petition of Kerry Hurwitz, Esq. appealing the response ofNewton Law Department (Department) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1 ). Specifically, Attorney Hurwitz requested copies of certain class materials. This request was the subject of previous appeals. See SPR 16/1205 Determination ofthe Supervisor ofRecords (December 19, 2016); SPR 17/066 Determination ofthe Supervisor of Records (January 13, 2017). In my January 13, 2017 Determination I closed the appeal with the proviso that a supplemental response be provided that included any responsive records that were left out of the original packet. In a January 13, 2017 email you notified this office that you had provided Attorney Hurwitz with all remaining responsive records. In a January 18, 2017 letter Attorney Hurwitz petitioned this office for further assistance as she believes there are still other records that have not been provided to her. As a result this appeal was opened. Subsequent to a telephone conversation with a member of my staff you explained that you would provide Attorney Hurwitz with another complete packet of materials, in the event that any were inadvertently left out. As such, I will now consider this administrative appeal closed. Attorney Hurwtiz may appeal the substantive nature ofthe Department's response within ninety (90) days. See 950 C.M.R. 32.08(1).
