G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Ms. Berg requested "copies of public records that relate to a complaint made regarding a violation of the Massachusetts Sanitary Code 1 05 CMR 41 0" at a specifically identified address. Having not received a response, Ms. Berg petitioned this office. Subsequent to intervention by a member of my staff, I learned that the Department has provided Ms. Berg with a response sent via mail on January 24, 2017. Whereas this matter was opened on the basis of the Department's failure to provide a written response, I will now consider this administrative appeal closed.
