Office of the Chief Legal Counsel Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney Farrell: I have received the petition of Nestor Ramos of The Boston Globe appealing the nomesponse of the Department of State Police (Department) to three (3) separate requests for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, Mr. Ramos requested: 1. All legal settlement agreements entered into by the Massachusetts State Police from 2010 through the most recently available. (SPR 171117) 2. Electronic copies of every Massachusetts Commission Against Discrimination complaint against the Department of State Police, and the Department's responses, from 2010 to present. (SPR 17 /118) 3. All reports produced by the Massachusetts State Police Department's Harassment Investigation Unit from 2010 to present. (SPR 17 /119) Mr. Ramos informed this office that he did receive a letter explaining that additional time would be required to respond to Requests #2 and #3, but has not received any final response. He states that he received no response to Request #1, and as such petitioned this office. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (10) days ofthe request. G. L. c. 66, § lO(b); 950 C.M.R. 32.05. The response may be an offer to provide records, a fee estimate for provision of the records, or a denial. Al records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the intervention by a member of my staff, you were provided with copies of each of the files associated with these appeals.
