City of Boston - Police Department Office of the Legal Advisor One Schroeder Plaza Boston, MA 02120-2014 Dear Attorney Hoffman: I have received the petition of Michael Gordon appealing the response of the City of Boston-Police Department (Department) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Gordon requested a number of records in the possession of the Boston Police Department. This request was the subject of a previous appeal. See SPR16/1241 Determination of the Supervisor of Records (December 30, 2016). In a response to Determination SPR16/1241, the Department provided Mr. Gordon with a response dated January 6, 2017. The Department denied his request based on the unclear nature of the request. The Department explained that Mr. Gordon could resubmit his request asking that he provide as much information as possible so the Department could process the request. In a conversation with a member of my staff, the Department confirmed receipt of a letter from Mr. Gordon's clarifying his request. The Department also confirmed that it is currently in the process of providing Mr. Gordon with a supplemental response. Accordingly, I will consider this administrative appeal closed with the proviso that the Department provides said response. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Gordon may appeal the substantive nature of the Department's response within ninety (90) days.
