The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records January 30, 2017 SPR17/130 Patrick Higgins Dear Mr. Higgins: This office has received your January 28, 2017 emails appealing the lack of compliance ofthe City of Fall River (City) to your records requests. After reviewing this information I find that I am unable to accept your appeal. The Public Records Access Regulations, which govern the procedural aspects of all appeals, provide records custodians with ten (1 0) business days in which a response to a public records request must be provided. See 950 C.M.R. 32.06 (2) (b); G.L. c. 66, § 10(b). The 10- day time frame in which a custodian must respond has not yet elapsed. If after 10 -business days have passed and the City denies your request or fails to respond, you may appeal to this office. At that time this office will review the matter. Sincerely, ~~ Supervisor of Records cc: Alison M. Bouchard One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us
