O'Connor Board Counsel Division of Professional Licensure 10 00 Washington Street Boston, MA 02118 Dear Attorney O'Connor: I have received the petition of Robert Anderson appealing the response of the Division of Professional Licensure (Division) to a request for public records. G. L. c. 66 § 1O (b ); see also 950 C.M.R. 32.08(2). Specifically, Mr. Anderson requested licensee information for four specifically identified individuals. Initially, the Division provided information regarding three of the individuals and stated the Division had no information on the fourth individual. Mr. Anderson believed the response regarding the fourth individual was erroneous and appealed to this office. Under the Public Records Law and the Access Regulations (Regulations) all requests for public records must be met with a response within ten (10) days of the request. G. L. c. 66, § 10(b); 950 C.M.R. 32.05. The response may be an offer to provide records, a fee estimate for provision of the records, or a denial. All records custodians must comply with both the Public Records Law and the Regulations with respect to the timeliness of response. Subsequent to the intervention by a member of my staff, this office was notified that a supplemental response will be provided to Mr. Anderson. I will consider this administrative appeal closed with the proviso that the Department provide Mr. Anderson with said response to his request, prepared in a manner consistent with the Public Records Law and its Regulations.
