Farrell, Esq. Office of the Chief Legal Counsel Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney Farrell: I have received the petition of Michael. Gordon appealing the response of the Department of the State Police (Department) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1 ). Specifically, Mr. Gordon requested nine (9) categories of documents and information regarding a specifically identified case that has been closed. This request was the subject of a previous appeal. See SPR16/1204 Determination of the Supervisor of Records (December 21, 2016). This office closed SPR16/1204 with the proviso that the Department provide Mr. Gordon with a response to his request. Having not received a response as ofthe date ofhis petition, which was January 20, 2017, Mr. Gordon appealed. Subsequent to the intervention by a member of my staff, this office was notified that you provided Mr. Gordon a letter dated January 23, 2017 with responsive records enclosed. Accordingly, I will consider this administrative appeal closed. Mr. Gordon may appeal the substantive nature of the Department's response within ninety (90) days. See 950 C.M.R. 32.08(1).
