G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, Ms. Berg requested "copies of public records that relate to a complaint made regarding a violation of the Massachusetts Sanitary Code 105 CMR 41 O" at a specifically identified address. Ms. Berg is appealing the substantive nature of the Department's January 23, 2017 response, believing that she has not received all responsive records. Subsequent to intervention by a member of my staff, I learned that the Def artment will be providing Ms. Berg with a supplemental response to their original January 23r response. Whereas this matter was opened on the basis of the Department's failure to provide a complete written response, I will now consider this administrative appeal closed with the proviso that the Department provides Ms. Berg with a supplemental response without delay.
