Murray Supervisor ofR ecords February 8, 2017 SPR17/179 Mr. John Spaulding Natick, MA 01760 Dear Mr. Spaulding, I have received your petition appealing the response of Natick Public Schools (School) to a request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1 ). Specifically, you requested a series of emails that you had sent to the School that were described as "nasty." This is the sixth (6th) appeal and determination issued by this office regarding this matter. Feeling unsatisfied with the response(s) issued by the School, you have appealed. Previous Appeals This appeal is the subject of five (5) previous appeals and determinations. See SPR16/894 Determinations of the Supervisor of Records (October 21, 2016); SPR16/1103 Determinations of the Supervisor of Records (December 2, 2016); SPR16/1209 Determinations of the Supervisor of Records (December 21, 2016); SPRl 7/86 Determinations of the Supervisor of Records (January 23, 2017); SPRl 7/107 Determinations of the Supervisor of Records (January 25, 2017). In my latest order I found that "The School has no obligation to determine with specificity which emails are regarded as "nasty,'' ... as this would be considered an answer to a question rather than compliance with the Public Records Law. By providing Mr. Spaulding with all emails that he sent to the School, the School has properly responded to his request." See SPRl 7/107 Determinations of the Supervisor of Records (January 25, 2017). After another careful and thorough review of this matter, I respectfully decline to reverse my findings. If you are not satisfied with the resolution of this administrative appeal, please be advised that this office shares jurisdiction with the Superior Court of the Commonwealth. See G. L. c. 66, § 1 O(b) (pursuing administrative appeal does not limit availability of applicable judicial remedies).
