I have received the petition of Cynthia Gardner appealing the nonresponse of the Village of Cotuit- Fire District (District) to a request for public records. G. L. c. 66 § 1O (A); see also 950 C.M.R. 32.08(1). Specifically, Ms. Gardner requested three (3) categories ofrecords. Ms. Gardner requested "January appropriation reports," "Answer regarding Chief search committee," and a specifically identified portion of an appropriation report regarding town budget information. Having yet to receive a substantial response, Ms. Gardner petitioned this office. Subsequent to the intervention by a member of my staff, this office was notified that a response was provided, dated February 15, 2017. Whereas this matter was opened based upon the District's failure to provide a written response, I will now consider this administrative appeal closed. Ms. Gardner may appeal the substantive nature of the District's response within ninety (90) days. See 950 C.M.R. 32.08(2). ~y~ Rebecca S.
