Murray Supervisor ofR ecords February 17, 2017 SPR17/201 Michael Farber c/o Mary Hartley Dear Mr. Farber: I have received your petition appealing the response of the Department of Environmental Protection (Department) to a request for public records. The requirements for an appeal are as follows: Such appeal shall be in writing, shall include a complete copy of the letter by which the request was made, including in the case of electronic communications all header information indicating time, date, subject, sender and recipient email addresses, and shall include a complete copy of all written responses from the records access officer associated with requests subject to the petition for appeal. The Supervisor of Records shall accept an appeal only from a person who has made his or her request in writing. An oral request, while valid as a public records request pursuant to 950 C.M.R. 32.06(1)(a), may not be the basis of an appeal under 950 C.M.R. 32.08(1)(c)(2017 ed.); see also 950 C.M.R. 32.08(g)(l),(2)(2017 ed.). Given that a copy of the original request was not included in your petition, we are unable to assist you at this time.
