Murray Supervisor ofR ecords February 21, 2017 SPR17/203 Michael Roth, CF A Bison Dear Mr. Roth: I have received your petition appealing the response of the Massachusetts Port Authority (Massport) to a request for public records. The requirements for an appeal are as follows: Such appeal shall be in writing, shall include a copy of the letter by which the request was made, and, if available, a copy of the letter by which the custodian responded. The Supervisor of Records shall accept an appeal within ninety (90) days from the date of the original request or the date of a response from the records custodian, and only from a person who has made his or her request in writing. An oral request, while valid as a public records request pursuant to 950 C.M.R. 34.05(3) (2016 ed.) may not be the basis of an appeal under 950 C.M.R. 32.08(2) (2016 ed.). The Supervisor of Records may also decline to accept an appeal from a requester if, in the opinion of the Supervisor, the public records request is made solely for a commercial purpose. 950 C.M.R. 32.05(3) (2016 ed.). Given that both your April 6, 2016 request and the April 7, 2016 response from Massport are past ninety (90) days, we are unable to assist you at this time. Please feel free to re-submit your appeal within ninety (90) days of a new request, and include all the required documents. Sincerely, Rebecca S.
