Homsy Assistant General Counsel Suffolk County Sheriffs Department 20 Bradston Street Boston, MA 02118 Dear Mr. Homsy: I have received the petition of Richard Libby appealing the nonresponse of the Suffolk County Sheriffs Department (Department) to a request for public records. G. L. c. 66 § lOA; see also 950 C.M.R. 32.08(1). Specifically, :Mr. Libby requested "A list of all people promoted or protected" by a specifically identified individual. Having received no response, :Mr. Libby petitioned this office. Subsequent to an intervention by a member of my staff, this office was notified that a response would be provided without delay. Whereas this matter was opened based on the Department's failure to provide a written response, I will now consider this administrative appeal closed with the proviso that :Mr. Libby receives a response to his request. :Mr. Libby may appeal the substantive nature of the Department's response within ninety (90) days.
