Murray Supervisor ofR ecords February 27, 2017 SPR17/244 Lisa Munger Dear Ms. Munger: I have received your request for reconsideration of the previous written determinations pertaining to your request to the Westport Police Department (Department). See SPR 16/377 Determination of the Supervisor of Records (June 20, 2016; October 19, 2016). Specifically, you requested records related to a suspicious death investigation conducted by the Department in January 1996. In the June 20th determination, I closed the appeal as the Department explained that it has no records responsive to the request. Subsequently, you requested a reconsideration of this office's determination. In the October 19th determination, this matter was closed with this office declining to reverse the previous findings. Under the Public Records Law there is a presumption that public officials perform their duties in an honest and impartial manner. LaPoint v. License Bd. of Worcester, 389 Mass. 454,459 (1983); see also Konover Mgt. Com. v. Planning Bd. of Auburn, 32 Mass. App. Ct. 319, 326 (1992) (presumption that public officials will perform honestly and impartially). After another careful and thorough review of this matter, I respectfully decline to reverse my findings. If you are not satisfied with the resolution of this administrative appeal, please be advised that this office shares jurisdiction with the Superior Court of the Commonwealth. See G.
