Hamilton Records Access Officer City of Everett - Police Department 45 Elm Street Everett, MA 02149 Dear Captain Hamilton: I have received the petition of Julian Castle Logan appealing the nonresponse of the City of Everett - Police Department (Department) to a request for public records. G. L. c. 66 § 1O A; see also 950 C.M.R. 32.08(1). On February 5, 2017, Mr. Logan requested a copy ofrecords regarding an identified person, specifically: 1. The evidence log book showing property removed from this person, 2. Any record showing the name of the Department officer who booked the person, 3. Any record showing whether the property was returned to the person, and 4. The complaint regarding any charge(s) the person was booked for. This appeal was opened based on Mr. Logan's petition that no response was provided to his February 5th request. However, you provided this office with a copy of a February 6, 2017 response that the Department provided to Mr. Logan. Petitions to the Supervisor of Records Mr. Logan is reminded that under the new requirements in the Public Records Law, when petitioning the Supervisor of Records (Supervisor) for an appeal, the requester shall provide to the Supervisor complete copies of all correspondence associated with the petition, including all written responses associated with requests subject to the petition for appeal. 950 C.M.R. 32.08(1)(g). Additionally, in petitioning the Supervisor, the requester shall provide a copy of such petition to the Records Access Officer (RAO). 950 C.M.R. 32.08(1)(h)(2017 ed.).
